.htaccess/config.php error

My hoster swapped servers which screwed up most everything and I had lost my gallery. So I go to reset the thing back up and now I'm getting

Error: You must create an empty file named config.php and chmod it 777 before proceeding.

Error: You must create an empty file named .htaccess and chmod it 777 before proceeding.

Now I have these empty and set at 777. I even went to the gallery/setup and changed that .htaccess to 777 as well which is empty and it still doesnt go through. I've even dumped those files and put them back up and set to 777 just to see if the file was somehow corrupt. What else can I try?

Gallery version: 1.44 (which I had operational before the server swap)
Apache version: 1.3.33 (Unix)
PHP version (don't just say PHP 4, please): 4.3.10
Graphics Toolkit: ImagicMagick-6.2.1
Operating system: Linux
Web browser/version (if applicable): Opera/Firefox

http://www.hterry.com/gallery/config.php -- That gives a 404 - Not found message. The file is not there.

hmm lemme go look again

okay I copied a config.php in the gallery setting and tried again, now I"m just left with a .htaccess error

I went ahead and copied a htaccess to that same folder and viola

tks your a big help.
