upgrader not found

my gallery3 installation is stating that modules are out of date, but everytime I try to run the upgrader I get that iscannot be found. i did try modifying the php.ini for the fix cgi path = 1 and .htaccess modifications (i am using the mod_rewrite) everything else is working fine, just can't upgrade anything. any thoughts??
